Creators Company LLC provides services through its own websites and mobile apps and through other online platforms such as partners’ websites and social media. The information that follows applies to all of these platforms.

We collect, process and use your personal data only with your consent or when this processing or use is permissible by law. We only process or use the data which is required for using our websites and provide our services, or the data which you provide to us.

Privacy

1. What kind of personal information does Happy Bellyfish collect and process?

(a) Data collection when you contact us / inquire about our services, products, tours or other matters

When you send us an inquiry, you will be asked about your name and email address. This data will only be used for communication with you concerning your inquiry, including booking of our services, processing payments etc. We might contact you with a request to leave a review or evaluate our services, as well as for partnerships and other relevant offers.  This data will be stored for as long as it is necessary for communication with you about your inquiry. You can opt out of this communication at any time.

(b) When you pay for our services, buy our products or make a reservation

When you make a reservation, purchase our product or our services, you’ll be asked for your name, address, telephone number, email address, payment details, the names of guests traveling with you, your preferences and for other information if required by activities provider. We may also receive information about you when you use certain social media services. During the purchase we may collect a unique transaction and order number, associated with your purchase, which is necessary to process the orders effectively. If you pay for our services when logged in, we will collect your account ID in order to link your order to your account on your dashboard.

All payments are processed through third party services like PayPal, Stripe, WeTransfer. In exceptional cases payments may be processed through bank transfers. You have to provide necessary payment and billing data directly to these services. It may include your full name, billing address, zip code, credit card information, bank account information. We do not collect and store any payment information.

(c) When you create an account on https://happybellyfish.com, https://school.happybellyfish.com

To make it easier to manage your reservations, you can open a user account. This allows you to save your personal settings, review previous bookings and manage future reservations. When you create your account, the following personal information is stored on our services: your full name, email address, location, profile picture as well as any other data that you decide to provide to us. When your account is deleted, your personal data will be deleted permanently as well.

(d) When you comment, leave reviews, interact on our website with other users

When you leave comments or reviews, we will ask you for your name, email address and sometimes location. If the comment or the reviews are deleted, the information will be permanently deleted as well.

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

(e) When you register or log in with social media accounts

If you decide to register or / and login with one of your social media accounts (like Facebook, Twitter, Google etc.), we will ask for your permission to access a certain data from that account. This information may include (depending on the platform): your email address, full name, account ID number, profile picture, location, gender, birthday, list of friends. This information is available through the APIs of those social networks. You can always decide which information you provide to us.

Collection, use and sharing of your data through third-party services is also a subject to Privacy Policy and Terms and Conditions of those services accordingly.

(f) Embedded content from other websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracing your interaction with the embedded content if you have an account and are logged in to that website.

2. What non-identifiable information do we collect and process?

Non-identifiable information means that this information is not attributed to any individual, and is only processed when aggregated.

When you visit our website, even if you don’t make a reservation, we may collect certain information, like browser, and information about your computer’s operating system, application version, language settings and pages that have been shown to you. If you’re using a mobile device, we might also collect data that identifies your mobile device, device-specific settings and characteristics and latitude/longitude details.

3. How does Happy Bellyfish use personal data?

(a) We only collect personal information which is necessary for the use of our services (like reservations and payment processing) and the use of our websites. We forward the information which is filled in in the reservation form to the service provider, with whom you book your activity. It is necessary in order to complete online reservations.

(b) Based on the information you share with us, individualized offers may be shown to you on the Happy Bellyfish website, in mobile apps or on third-party websites, including social media sites. Individualized ads may be shown to you through third-party providers like Google and their advertising network, and Facebook.

(c) If you opted in for marketing communication or Happy Bellyfish Newsletter, we may contact you to notify about our special offers, to share company news and Happy Bellyfish Newsletter. You can opt-in or opt-out at any time. We may also use your contact information to invite you to write a review of your activity. This can help other users choose an activity that suits them best.

(d) We use your personal information as permissible by law, for example for marketing activities by mail. You may object to this use.

(e) We may get in touch with you by email, by post, by phone or by texting you, depending on the contact information you share with us. There could be a number of reasons for this:

– We may need to respond to and handle requests you have made

– If you haven’t finalized a reservation or a product purchase online, we may email you a reminder to continue with your reservation. We believe that this additional service is useful to you because it allows you to carry on with a reservation without having to search for the service items again or fill in all the reservation details from scratch

– When you use our services, we may send you a questionnaire or invite you to provide a review about your experience with Happy Bellyfish

– We may also send you other material related to your reservation, such as how to contact Happy Bellyfish if you need assistance while you’re away, or a summary of previous reservations you made using Happy Bellyfish

– We may contact you regarding and administrative or technical issues, that are relevant to your use of our website

You can opt out of this communication at any time. You can do so by contacting us directly (contact@happybellyfish.com) or by following the Unsubscribe instructions in your email.

(f) We sometimes ask our customers to take part in market research. Any additional personal details that you give us as part of the market research will only be used with your consent.

(g) We may use personal data for the detection and prevention of fraud and other illegal or unwanted activities.

(h) Finally, we use personal information for analytical purposes, to improve our services, enhance the user experience, and improve the functionality and quality of our online services and products.

4. How does Happy Bellyfish use social media?

We use social media to promote our partners’ activities and to promote, improve and facilitate our own services website. For example, we integrated social media plugins into the Happy Bellyfish website.

In addition to implementing these buttons, Happy Bellyfish uses social media by maintaining accounts on several social media sites and by offering social apps. These social media services may allow you to share information with Happy Bellyfish. When you register with a social media app, you’ll be told which information will be shared with Happy Bellyfish. The information you choose to share with us may include the basic information that’s already available in your social media profile, like your name and email address.

We may also enable you to sign in to Happy Bellyfish services with your social media accounts. Your social media provider will be able to tell you more about how they use and process your data in such cases.

5. Does Happy Bellyfish share your data with third parties?

In certain circumstances, we may share your personal data with third parties:

With our partners, whose services you book or whose products you purchase. In order to complete your reservation, we need to transfer relevant reservation details to the partners you booked with, or we may have to share your address with a partner to deliver a purchased product to you. This may include information like your name, contact and payment details, the names of guests traveling with you and any preferences you specified when making a booking. We may use third-party service providers to process your personal information on our behalf for the purposes specified above. For example, we may use service providers to send the reservation information on our behalf to the service item you just booked, or we may instruct third parties to contact you.

With other users of the website. If you leave a review or comment, other users might see your personal information that you provided, for example your name and your profile picture.

With a third-party service providers. We may share your data with third-party service providers who perform services on our behalf, it includes analytics and advertising. When a reservation requires it, we may also work with third-party payment service providers to facilitate payment or payment guarantees. We also work with third-party advertisement networks to market our activities on other platforms, or involve third-party providers for analytical purposes.

For all email communication we use services like MailChimp and MailerLite. For the reasons of email communication your name, email address and subscription settings are stored on their servers. You can request all information to be deleted or shared with you any time.

As a result of a merger, acquisition, corporate divestiture, or dissolution (including bankruptcy), a sale of all or some of our assets. In case of one of these business transactions we may share, disclose or transfer your information in part or fully to the successor organization

6. How does Happy Bellyfish use reviews and other activity-related information you share with us?

After you attend an activity booked through us, or purchase a different product, you’ll be invited to submit a review of this activity or a product. If you don’t want your name to show with your review, you can use your screen name (which you can choose in your user account) or it can be displayed anonymously. By completing a guest review, you’re agreeing that it can be displayed on, for example, the relevant service information page on our websites, in our mobile apps, in our social media accounts and in social apps, or on the website of the relevant property or on our business partner’s website, to inform other customers about the quality of the service item you used.

If you indicate that someone’s review was helpful – or not helpful – we will aggregate this with feedback from other customers in order to sort and prioritize guest reviews.

7. How long do you retain data?

We do not keep your personal information for more than necessary to fulfil the purposes we collected it for. It includes the purpose to meet any legal, accounting, or reporting requirements.

For tax purposes we are bound by law to keep provided information about our customers and their purchase for ten years. It  may include contact information, name, billing and physical address, financial and transaction data.

8. Security

What security procedures does Happy Bellyfish put in place to safeguard your personal data?

In accordance with European data protection laws, we observe reasonable procedures to prevent unauthorized access and the misuse of personal information.

We use appropriate business systems and procedures to protect and safeguard the personal information you give us. We also use security procedures and technical and physical restrictions for accessing and using the personal information on our servers. Only authorized personnel are permitted to access personal information in the course of their work.

9. Children

The services offered by Happy Bellyfish are not directed at children under 18 years old. The use of any of our services is only allowed with the valid consent of a parent or a guardian. If we receive information from a child under 18 years old, we reserve the right to delete it.

11. How can you control the personal data you have given to Happy Bellyfish?

You always have the right to review the personal information we keep about you. You can request an overview of your personal data by emailing us at contact@happybellyfish.com. Please write “Request personal information” in the subject line of your email and include a copy of your identity card to help us prevent unauthorized individuals from accessing your personal data.

If the personal information we have for you is incorrect, we will update it at your request. You can also ask us to remove your personal data from our customer database by sending an email to contact@happybellyfish.com with “Request for removal of personal information” in the subject line. However, we may need to retain certain information, for example, for legal or administrative purposes, such as record keeping or to detect fraudulent activities. You can delete your user account at any time by signing into your account on the Happy Bellyfish website and choosing to remove your account.

The cookies we use have varying lifespans. The maximum lifespan we set on some is five years from your last visit to our website. You can erase all cookies from your browser any time you want. You can do it through the settings of your browser.

Does Happy Bellyfish use third-party analytics cookies?

Does Happy Bellyfish use third-party marketing and advertising cookies?

We use third-party advertising services like Facebook and Google’s ad services to deliver advertising about our services and products. These ads may be based on data about you that these third-party advertising services have collected through their own tracking means (please see Privacy Policy of these third-party services, Facebook and Google, accordingly). It will mostly include your activity and interaction with other websites and services over a period of time. This data helps to identify your interests and deliver you ads that are relevant to you. To help deliver tailored advertising, we may provide these service providers with a hashed, anonymized version of your email address (in a non-human-readable form) and content that you share publicly on the Services.

Google Analytics collects data for Display and Search Remarketing. This includes data from Google’s signed-in users who have chosen to enable Google to associate their web and app browsing history with their Google account, and to use such information from their Google account to personalize ads.

Who has access to cookie data?

Only Happy Bellyfish has access to its own cookies. Cookies placed by third parties can be accessed by these third parties.

How can you manage your cookie preferences?

Using your browser settings in, for example, Internet Explorer, Safari, Firefox or Chrome, you can set which cookies to accept and which to reject. Where you find these settings depends on which browser you use. Use the “Help” function in your browser to locate the settings you need. Does Happy Bellyfish use web beacons?

In addition to using cookies, Happy Bellyfish sometimes uses web beacons. A web beacon is a tiny graphic image of just one pixel that’s delivered to your computer either as part of a web page request or in an HTML email message. Either directly or through service providers, we use these pixels as part of our online advertisements either on our website or on third-party websites to learn whether a user who is being shown an online advertisement also makes a reservation; to track conversion with partner websites and to analyze a user’s traffic patterns in order to optimize the services we bring to you.
